Terms of Service

These Terms of Service ("Terms") govern your access to and use of Fast Estimate (the "Service"), operated by Fast Estimate LLC ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.
1. Eligibility and Account Registration
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
2. Description of Service
Fast Estimate provides AI-assisted job estimating tools for HVAC contractors, including estimate generation, branded PDF export, e-signature collection, and related features described on our website. Plan features and limits (Solo, Crew, Fleet) are as described on our Pricing page and may be updated from time to time.
3. AI-Generated Estimates — Important Disclaimer
Fast Estimate uses artificial intelligence to suggest line items, quantities, and pricing for job estimates based on the information you provide. AI-generated estimates are suggestions only and are not guaranteed to be accurate, complete, or appropriate for any specific job. You are solely responsible for reviewing, editing, and verifying all line items, pricing, and totals before sending any estimate to a customer. We are not responsible for any losses, disputes, or damages arising from inaccurate estimates, underbidding, overbidding, or any reliance on AI-generated content without independent review.
4. Customer Data You Submit
When you use the Service to create estimates, you may enter personal information about your own customers (names, contact information, addresses, photos). You represent that you have the necessary rights and permissions to submit this information and that doing so complies with applicable law. You are responsible for your own compliance with any data protection or privacy laws applicable to your business and your handling of your customers' information.
5. E-Signatures
The Service allows your customers to sign estimates electronically through a signing link. Electronic signatures collected through the Service are intended to indicate agreement to the terms of the estimate. You are responsible for determining whether the e-signature functionality meets your legal or contractual needs for any given transaction.
6. Subscriptions and Payment
Paid plans (Crew, Fleet) are billed in advance on a monthly or annual basis through our payment processor, Stripe. Subscriptions automatically renew until canceled. You may cancel at any time through your account settings or the Stripe billing portal; cancellation takes effect at the end of the current billing period, and we do not provide prorated refunds for partial billing periods except where required by law.
7. Acceptable Use
You agree not to: use the Service for any unlawful purpose; attempt to gain unauthorized access to the Service or other users' accounts or data; upload malicious code; or use the Service to harass, defraud, or mislead any customer.
8. Intellectual Property
We retain all rights to the Fast Estimate software, branding, and platform. You retain ownership of the estimate content, photos, and customer data you submit. You grant us a limited license to process and store that content solely as necessary to provide the Service to you.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI-GENERATED ESTIMATES WILL BE ACCURATE OR SUITABLE FOR YOUR SPECIFIC JOBS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAST ESTIMATE LLC AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE, INCLUDING ANY RELIANCE ON AI-GENERATED ESTIMATE CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Termination
We may suspend or terminate your account if you violate these Terms. You may cancel your account at any time. Upon termination, your right to use the Service ends, though certain provisions of these Terms (including Sections 9, 10, and 12) will survive termination.
12. Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws principles.
13. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page with a revised "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
